Terms of Service
1. The agreement
“Quest Portal”, “we”, “us” means Tuffle (Pty) Ltd, a South African company. “You” means the person creating an account or using the platform. By using Quest Portal you agree to these terms and to our Privacy Policy.
2. Accounts and eligibility
- You must be at least 18 years old, or have parental or guardian consent to use the platform.
- You must give accurate information when registering and keep it current.
- You are responsible for keeping your password confidential and for all activity under your account.
- One person, one account per role. We reserve the right to merge or remove duplicate accounts.
3. Acceptable use
You agree not to:
- Use the platform for unlawful purposes or to harass other users.
- Attempt to access accounts, data, or systems you are not authorised to access.
- Resell tickets at a markup, except where the organizer has explicitly enabled transfer or resale.
- Submit false vendor or organizer applications, or impersonate another person.
- Probe, scan, or scrape the platform in ways that affect availability for other users.
4. Tickets and refunds
- Tickets you buy are sold by the organizer of the event, not by Quest Portal. We facilitate the sale and the payment.
- Refund policies are set by the organizer and shown at checkout. The Consumer Protection Act gives you certain non-waivable rights, including a right to a refund if the event is materially changed or cancelled.
- If an event is cancelled, the organizer is responsible for the refund. We coordinate the refund through the original payment method.
- Disputes must be raised within 30 days of the transaction. Card chargebacks are governed by your card scheme's rules.
5. Vendor applications
- Submitting an application does not guarantee approval. Organizers decide.
- You are responsible for the accuracy of every field in your application.
- You authorise the organizer of an event you apply to to view, retain, and use your application data to make their decision and run the event.
6. Organizer obligations
- You are responsible for the lawfulness of your event, including all licences, taxes, health and safety obligations, and any data protection obligations toward attendees.
- You may only contact attendees and applicants for purposes related to the events they have engaged with, and only through the channels they have consented to.
- You are responsible for honouring the refund and access policies you advertise.
- Quest Portal may suspend or remove an event that materially violates these terms or applicable law.
7. Fees
- Quest Portal charges organizers a service fee on paid ticket sales. The fee is shown to organizers at the time of event creation and on every payout statement.
- Adventurers do not pay a separate platform fee — the price you see at checkout is the total you pay.
- Payment processing fees are passed through from our payment provider at cost.
8. Liability
Quest Portal is provided on an “as available” basis. We are responsible for the platform itself; we are not responsible for the events listed on it, the conduct of organizers or vendors, or any injury, loss, or damage arising from attendance at an event. To the maximum extent allowed by law, our total liability for any claim arising from your use of the platform is limited to the total fees you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited.
9. Termination
- You can close your account at any time by contacting support.
- We may suspend or terminate your account if you breach these terms, abuse the platform, or expose us to legal risk.
- Account closure does not erase historical financial records, which we retain for tax and audit reasons. See the retention section of our Privacy Policy.
10. Disputes and governing law
These terms are governed by the law of the Republic of South Africa. Any dispute that cannot be resolved through good-faith conversation will be referred to mediation, and failing that, to the courts of South Africa with appropriate jurisdiction.
11. Changes to these terms
We may update these terms from time to time. Material changes are announced on the platform and recorded with a new policy version. Your continued use of Quest Portal after a change means you accept the updated terms.
